Registration

You may open an account on our website. During this process, you may be asked to choose a password. You are responsible for maintaining the confidentiality of passwords and account information and you agree not to share your passwords, account information or secure access to our website or services with any other person. You must not allow any other person to use your account to access the website as you are responsible for all activities that occur under your passwords or accounts. You must notify us immediately if you become aware of any disclosure of your password.

After the account is closed, you will not attempt to open a new account without our permission.

 

Refund and return policy

9.1 Right of withdrawal

In accordance with Article L.121-16 of the French Consumer Code, the consumer has a period of 7 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund without penalty, with the exception of the return costs.

Only products returned in their entirety, in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product that has been damaged or whose original packaging has been damaged will not be refunded or exchanged.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can find our contact details below. You can use the attached sample cancellation form, but this is not obligatory.

If you use this option, we will immediately send you an acknowledgement of receipt of this withdrawal on a durable medium (e.g. by e-mail).

In order to comply with the withdrawal period, it is sufficient to send your communication regarding the exercise of your right of withdrawal before the expiration of the withdrawal period.

9.2 Effects of withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery type other than the cheapest standard delivery type offered by us), without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from this contract. We will make this refund using the same method of payment that you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of this refund.

You must return the goods or hand them over to us or to a person authorised by us to receive the goods without undue delay and in any event no later than 14 days from the day you notify us of your withdrawal from this contract. The time limit is met if you return the goods before the expiry of the 14 day period.

We may suspend the refund until we have received the returned goods or you have provided proof that you have returned the goods, whichever comes first.

You will be responsible for the direct cost of returning the goods.

You are solely responsible for any diminution in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and function of the goods.

Please note that there are certain legal exceptions to the right of withdrawal, and therefore some items cannot be returned or exchanged. We will let you know if this applies to your particular case.

 

Idea submission

Do not submit any ideas, inventions, works of authorship or other information that may be considered your own intellectual property that you wish to present to us, unless we have previously signed an intellectual property agreement or non-disclosure agreement. If you disclose it to us in the absence of such a written agreement, you grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

Termination of Use

We may, in our sole discretion, at any time modify or discontinue, temporarily or permanently, access to the Website or any of the services on it. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of your access to or use of the website or any content you may have shared on the website. You will not be entitled to any compensation or other payment, even if certain features, settings and/or any content you have contributed to or relied upon is permanently lost. You must not circumvent or misuse, or attempt to circumvent or misuse, any of the restrictions on access to our website.

Breach of these terms and conditions

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we consider appropriate to deal with the breach, including temporarily or permanently suspending your access to the website, contacting your internet service provider to request that it block your access to the website, and/or taking legal action against you.

 

Force majeure

Neither party shall have failed to fulfil its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. Force majeure shall be considered to be all facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of them. The two parties will then, within one month, unless the force majeure event makes it impossible, meet to examine the impact of the event and agree on the conditions under which the performance of the contract will continue. If the case of force majeure lasts longer than three months, these general conditions may be terminated by the injured party. In addition to those usually retained by the jurisprudence of the French courts and tribunals, the following are expressly considered to be cases of force majeure or fortuitous events: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers.

Indemnification

You agree to indemnify, defend and hold us harmless from all claims, liabilities, damages, losses and expenses related to your violation of these Terms and Conditions and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for any damages, losses, costs and expenses related to or arising from such claims.

Waiver

Failure to enforce any of the provisions set forth in these terms and conditions and in any agreement, or to exercise any option to terminate, shall not be construed as a waiver of such provisions and shall not affect the validity of these terms and conditions or any agreement or any part thereof, or the right thereafter to enforce each provision.

Language

These terms and conditions shall be translated exclusively into French. All notices and correspondence shall be in that language only.

Full agreement

These terms and conditions, together with our privacy statement and cookie policy, constitute the entire agreement between you and Pierre Lescop concerning your use of this website.

Updating these terms and conditions

We may update these terms and conditions from time to time. It is your responsibility to periodically check these terms and conditions for changes or updates. The date shown at the top of these terms and conditions is the most recent revision date. Changes to these terms and conditions will be effective when posted on this website. Your continued use of this website following the posting of changes or updates will be deemed to be notice of your agreement to follow and be bound by these terms and conditions.

Choice of law and jurisdiction

These terms and conditions are governed by the laws of France. Any dispute relating to these terms and conditions shall be subject to the jurisdiction of the courts of France. If any part or provision of these terms and conditions is found by any court or other authority to be invalid and/or unenforceable under applicable law, that part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to effect the intent of these terms and conditions. The remaining provisions shall not be affected.

Article : Protection des mineurs

Conformément à l’article L. 3342-1 du Code de la Santé Publique qui stipule que la vente d’alcool à des mineurs est interdite, l’acheteur s’engage, en remplissant le bon de commande, à avoir dix-huit ans révolus à la date de la commande.

Article : Informations sur les produits

a) La société Mammenn Distillerie présente sur son site web mammenn.com les produits à vendre avec les caractéristiques nécessaires qui permettent de respecter l’Article L 111-1 du Code de la consommation, qui prévoit la possibilité pour le consommateur potentiel de connaître avant la prise de commande définitive les caractéristiques essentielles des produits qu’il souhaite acheter.
b) Les offres présentées par la société Mammenn Distillerie ne sont valables que dans la limite des stocks disponibles.

Article : Prix

Mammenn Distillerie se réserve le droit de modifier ses prix à tout moment mais s’engage à appliquer les tarifs en vigueur indiqués au moment de la commande, sous réserve de disponibilité à cette date.
Les prix sont indiqués en euros. Ils ne tiennent pas compte des frais de livraison, facturés en supplément, et indiqués avant la validation de la commande. Les prix tiennent compte de la T.V.A. applicable au jour de la commande et tout changement du taux applicable T.V.A. sera automatiquement répercuté sur le prix des produits de la boutique en ligne. Le paiement de la totalité du prix doit être réalisé lors de la commande. A aucun moment, les sommes versées ne pourront être considérées comme des arrhes ou des acomptes.

Article : Disponibilité des produits

Sauf en cas de force majeure ou lors des périodes de fermeture de la boutique en ligne qui seront clairement annoncées sur la page d’accueil du site mammenn.com, les délais d’expédition seront, dans la limite des stocks disponibles, ceux indiqués ci-dessous. Les délais d’expédition courent à compter de la date d’enregistrement de la commande.
France : Métropole = délai de 6 jours ouvrables à compter du jour suivant celui où le consommateur a passé sa commande.
En cas de retard, la responsabilité de Mammenn Distillerie ne pourra être engagée et ce, pour quelque cause que se soit. Par conséquent, aucune demande d’indemnisation, de quelque nature que ce soit, ne pourra être réclamée par le client à Mammenn Distillerie.
En cas d’indisponibilité du produit commandé, le consommateur en sera informé au plus tôt et aura la possibilité d’annuler sa commande. Le consommateur aura alors le choix de demander soit le remboursement des sommes versées dans les 30 jours au plus tard de leur versement, soit l’échange du produit.

Article : Modalités de livraison

Les produits commandés sont livrés par Collissimo ou par un transporteur indépendant, selon l’encombrement et le poids des produits commandés et à l’initiative exclusive de Mammenn Distillerie.
Aucune livraison n’est effectuée dans les campings, hôtels, postes restantes et boîtes postales. Les produits sont livrés à l’adresse indiquée par l’utilisateur sur le bon de commande, l’utilisateur devra veiller à son exactitude. Tout colis renvoyé à l’expéditeur à cause d’une adresse de livraison erronée ou incomplète sera réexpédié aux frais de l’utilisateur. Le consommateur peut, à sa demande, obtenir l’envoi d’une facture à l’adresse de facturation et non à l’adresse de livraison, en validant l’option prévue à cet effet sur le bon de commande.

Article : Problèmes de livraison du fait du transporteur

Vous devez indiquer sur le bon de livraison et sous formes de réserves manuscrites accompagnées de votre signature toute anomalie concernant la livraison (avarie, produit manquant par rapport au bon de livraison, colis endommagé, produits cassés…). Cette vérification est considérée comme effectuée dès lors que l’acheteur, ou une personne autorisée par elle, a signé le bon de livraison.
Vous devrez également confirmer par courrier recommandé ces réserves au transporteur au plus tard dans les deux jours ouvrables suivant la réception du ou des articles et transmettre une copie de ce courrier par simple courrier à : Mammenn Distillerie – Lieu dit Kerdélec – 29710 Pouldreuzic.
Si les produits nécessitent de nous être renvoyés, ils doivent faire l’objet d’une demande de retour dans les 7 jours suivant la livraison. Toute réclamation formulée hors de ce délai ne pourra être acceptée. Le retour du produit ne pourra être accepté que pour les produits dans leur état d’origine.
Si au moment de la livraison, l’emballage d’origine est abîmé, déchiré, ouvert, vous devez alors vérifier l’état des articles. S’ils ont été endommagés, vous devez impérativement refuser le colis et noter une réserve sur le bordereau de livraison (colis refusé car ouvert ou endommagé).

Article : Erreurs de livraison

a) Le consommateur devra formuler auprès de la société Mammenn Distillerie le jour même de la livraison ou au plus tard le premier jour ouvré suivant la livraison, toute réclamation d’erreur de livraison et/ou de non conformité des produits en nature ou en qualité par rapport aux indications figurant sur le bon de commande. Toute réclamation formulée au delà de ce délai sera rejetée.
b) La formulation de cette réclamation auprès de la société Mammenn Distillerie pourra être faite :
– En priorité par téléphone au 02 98 57 38 32 du lundi au samedi.
– En envoyant un email à l’adresse hello@mammenn.com avoir bien spécifié les références de la commande (N° et date).
c) Toute réclamation non effectuée dans les règles définies ci-dessus et dans les délais impartis ne pourra être prise en compte et dégagera la société Mammenn Distillerie de toute responsabilité vis à vis du consommateur.
d) A réception de la réclamation, la société Mammenn Distillerie procèdera à l’échange du ou des produit(s) concerné(s) et le communiquera par e-mail, par fax ou par téléphone au consommateur.
e) En cas d’erreur de livraison ou d’échange, tout produit à échanger ou à rembourser devra être retourné à la société Mammenn Distillerie dans son ensemble et dans son emballage d’origine, en Colissimo Recommandé, à l’adresse suivante : Mammenn Distillerie – Lieu dit Kerdélec – 29710 Pouldreuzic.
Pour être accepté, tout retour devra être signalé au préalable à la société Mammenn Distillerie.
Les frais d’envoi sont à la charge de la société Mammenn Distillerie, sauf dans le cas où il s’avérerait que le produit repris ne correspond pas à la déclaration d’origine faite par le consommateur dans le bon de retour.

Article : Garantie des produits

Conformément à l’Article 4 du décret n°78-464 du 24 mars 1978, les dispositions des présentes ne peuvent priver le consommateur de la garantie légale qui oblige le vendeur professionnel à le garantir contre toutes les conséquences des vices cachés de la chose vendue.

Article : Transfert de propriété – Transfert de risques

La société Mammenn Distillerie se réserve expressément la propriété des Produits livrés jusqu’au paiement intégral de leur prix en principal et en intérêts, et ce quelle que soit la date de livraison desdits produits. La simple remise d’un titre de paiement ne constitue pas un paiement. Les dispositions ci-dessus ne font pas obstacle au transfert au client des risques de perte ou de détérioration qui est effectif dès remise des produits au transporteur. À défaut de règlement intégral, la société Mammenn Distillerie sera en droit d’exiger la restitution du matériel livré. Les frais qui pourront être engagés pour cette restitution seront à la charge du client.

Article : Non validation partielle
Si une ou plusieurs stipulations des présentes conditions générales sont tenues pour non valides ou déclarées telles en application d’une loi, d’un règlement ou à la suite d’une décision définitive d’une juridiction compétente, les autres stipulations garderont toute leur force et leur portée.

Article : Non renonciation
Le fait pour l’une des parties de ne pas se prévaloir d’un manquement par l’autre partie à l’une quelconque des obligations visées dans les présentes conditions générales ne saurait être interprété pour l’avenir comme une renonciation à l’obligation en cause.

Article : Titre
En cas de difficulté d’interprétation entre l’un quelconque des titres figurant en tête des clauses, et l’une quelconque des clauses, les titres seront déclarés inexistants.
